Top Floor sells 10 floors of a drawn building, one tenant each, plus one advertising balloon. This page says what that gets you. It is written to be read, not to be survived.
1. What is for sale
There are 10 floors. Floor 1 costs $4 and each floor costs double the one below it, up to $2,048 for the penthouse. All 10 together come to $4,092. Separately, the balloon that crosses the sky costs $199.
Buying a floor gets you a name and a link displayed on that floor, a logo if you upload one, and an entry in the public registry of deeds. There is no auction and no queue: the first completed payment on a vacant floor takes it.
2. What “forever” means
The site says a floor is yours forever. Honestly: forever means for as long as Top Floor exists. Nobody can promise a website outlives them, and we are not going to pretend otherwise in the one document where it matters.
What we will commit to, and what you can hold us to:
- Your floor will not be resold, reassigned or taken back while you hold it, except under clause 6.
- The price of a floor will never change after it is sold, and no floor will be created or removed. Ten is the whole building.
- The registry is append-only. Nothing is ever deleted from it.
- If Top Floor is ever shut down, every tenant will be told first, and the registry will be published as a file so the record survives the site.
3. Paying
Payment is taken by Stripe. When you start a checkout the floor is held for you for 10 minutes so that nobody can buy it out from under you mid-payment; if you do not finish, it goes back on sale automatically.
Prices are in US dollars and exclude any tax that may apply where you are. If you are a business, you are responsible for your own VAT treatment.
4. Cancelling, if you are a consumer in the EU or UK
A floor goes live on the building the moment the payment clears. That is immediate performance, and it is why the checkout asks you to confirm that you want it that way.
Normally you would have 14 days to change your mind about something bought online. By asking for your floor to appear straight away, you agree to us starting immediately and you accept that once it is up, that right is gone. If you would rather keep the 14 days, write to us before paying and we will hold the floor without publishing it.
Businesses buying in the course of trade do not have this right in the first place.
5. Offers between tenants
Anyone can make a public offer on a floor that is already let. An offer is not a payment: no money is taken and nothing is held. It commits the person making it to nothing except being named on the building, and it commits the owner to nothing at all — nobody can be made to sell.
If an owner accepts, we put the two of you in touch. Top Floor is not a party to that sale, does not hold the money, and does not guarantee that either side does what they said they would. What we do is update the registry once both of you tell us it is done.
6. Names, logos and links
Everything published is reviewed by a person. We will refuse or remove anything that is unlawful, that impersonates someone else, that is hateful, that is sexual, or that links to malware or a scam. If we remove a floor for one of these reasons you get your money back in full, and that is the only refund the site gives.
You keep every right you have in your own name and logo. By uploading one you give us permission to display it on the site and in the image the site shares when the link is posted anywhere — no more than that.
7. The shared weather
Anyone can make it rain, turn the lights on, or call the cat. These change nothing you have bought: they cannot touch a name, a logo, a link, a price or the registry, and every one of them stops on its own within a minute. It is a toy and it is provided with no promises at all.
8. When things break
The site is provided as it is. It will sometimes be down. If it is down for a long stretch, or if a floor is displayed wrongly for a long stretch, tell us and we will fix it — but we are not liable for lost traffic, lost sales or anything else that follows from an outage.
Where liability cannot be excluded by law, it is limited to what you paid for your floor. Nothing here limits liability for death, personal injury, or fraud.
9. Law
These terms are governed by Spanish law. If you are a consumer, this does not take away the protection of the mandatory rules of the country you live in, and you can bring a claim there.
